This agreement regulates the relationship between the “Sitera Hotel Innovation GmbH” company (“agent”) and any person who has reached 18 years of age (“customer”).
The agent provides intermediary services (“services”) for purchasing the merchandize from the online stores in Germany and other countries of the European Union (EU), following the terms of service presented here.
The agent reserves the right to make changes to the presented agreement. The customer must independently and on a regular basis follow up on any changes to the agreement posted on the website WWW.INTERFAMILYSHOP.COM
The customer agrees to the Terms of Service when he or she places an order on the website WWW.INTERFAMILYSHOP.COM
The agent does not charge commission for the services. The 10% commission from the total cost of the items (excluding shipping) is charged only in case the seller from who the purchase was made (requested by the customer), does not listVAT (Value-Added Tax) in the invoice, or if the seller is from any EU country excluding Germany.
Terms or Service
The customer must make sure that the order information entered on the website is correct and complete. All the details must either be copied and pasted into the fields or typed manually. The agent does not hold responsibility if for any reason the order details were entered incorrectly by the customer. If this type of order is refused, the customer must compensate the agent all the costs that the agent endured…
The agent agrees to pay the seller for the items ordered by the customer from the agent’s name but charging the customer directly, given that the seller delivers to Germany and other countries of the EU.
In case the items requested by the customer are unavailable from the seller, the agent can back order the items and notify the customer via the e-mail address provided by the customer during the registration. This information will also be reflected in the customer’s account.
The agent agrees to store the merchandise delivered by the seller in their storage facility.
In the event that the seller fails to deliver the merchandise, the agent does everything possible to get the money back from the seller but cannot guarantee the refund, and therefore, cannot guarantee the compensation to the customer. Given that the customer self-reliantly chooses a seller when placing an order, the agent does not hold responsivity for the seller’s actions.
If the customer wishes to return the items that were already paid by, he or she must pay return shipping to the seller. The commission remuneration, if any, is not returned to the customer.
The agent reserves the right to refuse service to the customer if the merchandise requested for purchase is on the list of items prohibited for shipment into the country of receiver, or if the items are prohibited for shipment from Germany.
The agent reserves the right to refuse service to the customer in the event the customer is using insulting language towards the agent.
The service is considered fully executed by the agent once the package is transferred to shipping service.
Order Costs Breakdown
Total cost of the order consists of: item cost (price in the online store) +10% commission from the item cost or total cost (in the event that the seller from who the purchase was made (requested by the customer), does not listVAT in the invoice + cost of shipping to the agent + cost of shipping to the customer’s address provided during registration.
Delivery is performed by DHL to the following countries: Russia, Belarus, Ukraine, Kazakhstan, Armenia, Georgia, Azerbaijan, Kyrgyzstan, Uzbekistan, and Israel.
The following payment methods are accepted: PayPal, Western Union money transfer, Postbank money transfer to a bank account in Germany. All ordered are pre-paid and are completed by using a payment balance in customer’s account on our website WWW.INTERFAMILYSHOP.COM
The agent commits to provide service to a customer and meet any requests related to the service, if the said requests do not go against any of the terms and conditions outlined in this agreement or against German legislation.
The customer commits to pay for the orders in full and in a timely manner, including the costs of shipping to the agent, taxes, other costs incurred by the agent while providing the service, as well as agent commission (if any applies), and costs of shipping to the customer.
The customer commits to independently track the package using the DHL and Post Office tracking information provided by the agent.
Returns and Exchanges
The customer holds a right to refuse ordered merchandise within 48 hours of items being received by the agent. The refusal is only accepted in writing via e-mail. In the event items are refused, before they are picked up by the shipping service for delivery to the customer, the customer will be charged the shipping fee to return the items back to the seller. The commission (if any applies) is not returned. The refund is provided to the customer only after a full refund for the items is received by the agent.
The refund policy in German stores allows for items to be returned within 14 days of purchase (delivery to the agent). Due to the fact that delivery to the customers outside of Germany exceeds 14 days, the customer is not able to return the purchased merchandise.
Both sides are relieved of responsibility for not meeting the obligations in the outlined agreement, if the failure to abide was due to circumstances beyond one’s control that could not be foreseen or prevented (force majeure). Some of the examples include fire, earthquake, storm, epidemic, other natural disasters, as well as war or war-like actions, etc.
Resolution of Disputes
Any disputes and disagreements related to the conditions in this agreement are resolved through a discussion. In case the dispute cannot be resolved through a discussion, it is resolved following the guidelines set by the German law.
The customer guarantees that he or she understands the outlined agreement and accepts all the sections fully and completely.
